CONDITIONS OF ACCESS AND USE

RPET FLAKE, S.L., responsible for the website (hereinafter, “RPET FLAKE”), makes this document available to users, with which it intends to comply with the obligations set forth in Law 34/2002, of 11th July, on Information Society Services and Electronic Commerce (LSSICE), as well as to inform all users of the Website about the conditions of access and use.

Any person accessing this Website shall be considered its user (hereinafter, the “User” or “Users”), and undertakes to observe and comply with the provisions set forth herein, as well as any other legal provision that may be applicable. In the event of not agreeing with all or part of these Conditions of Access and Use, the User must abstain.

Through our Website, we offer our Users the possibility of accessing information and publicity about our services. 

The use of the Website is free of charge, however, its consultation from devices with internet connection may imply a data consumption. RPET FLAKE is not responsible for the costs incurred by the user in communicating and sending data or connecting to the Internet.

3. INDUSTRIAL AND INTELLECTUAL PROPERTY

The User acknowledges and accepts that all the contents shown on the Website, especially designs, texts, images, logos, icons, buttons, software, commercial names, brands or any other signs susceptible of industrial and/or commercial use are subject to intellectual property rights and all brands, commercial names or distinctive signs, all industrial and intellectual property rights on the contents and/or any other elements inserted in the page, are the exclusive property of the company and/or third parties, who have the exclusive right to use them in the economic traffic. RPET FLAKE is also the owner of the elements that make up the graphic design of the Website, the menus, navigation buttons, HTML code, texts, images, textures, graphics and any other content of the Website or, in any case, has the corresponding authorisation for the use of such elements.

The User undertakes not to reproduce, copy, distribute, make available or in any other way publicly communicate, transform or modify such contents, holding RPET FLAKE harmless from any claim arising from the non-fulfilment of such obligations. Likewise, the User undertakes not to remove, evade and/or manipulate the copyright as well as the technical protection devices or any other information mechanisms that may be contained in the contents. 

Under no circumstances does access to the Website imply any kind of waiver, transmission, licence or total or partial transfer of said rights, unless expressly established otherwise. These Conditions of access and use of the Website do not grant Users any other right of use, alteration, exploitation, reproduction, distribution or public communication of the Website and/or its contents other than those expressly provided for herein. Any other use or exploitation of any rights shall be subject to the prior and express authorisation specifically granted for this purpose by the company or third party owner of the rights affected.

The User undertakes to respect the aforementioned rights and to avoid any action that may be prejudicial to them, and RPET FLAKE reserves the right to exercise any legal means or actions that may correspond to it in defence of its legitimate rights.

4. OBLIGATIONS AND RESPONSIBILITIES OF THE USER OF THE WEBSITE

The User undertakes to:

1. To make appropriate and lawful use of the Website, as well as of the contents and services, in accordance with: (i) the legislation applicable at all times; (ii) the Conditions of access and use of the Website; (iii) generally accepted morals and good customs and (iv) public order.
2. To provide all the technical means and requirements necessary to access the Website.
3. To provide truthful information when filling in the forms contained on the Website with their personal data and to keep them updated at all times. The User shall be solely responsible for any false or inaccurate statements made and for any damage caused to the company or third parties as a result of the information provided.

Likewise, the User must abstain from:

3. Introduce or spread computer viruses, Trojans, worms, logic bombs or any other physical or logical systems that may cause damage to the systems of RPET FLAKE, its suppliers or third parties.
4. Attempt to access, use and/or manipulate the data of the company, third party suppliers and other Users.
5. Reproduce or copy, distribute, allow public access through any form of public communication, transform or modify the contents, unless authorised by the holder of the corresponding rights.
6. Delete, conceal or manipulate the notes on intellectual or industrial property rights and other data identifying the rights of the company or third parties included in the contents, as well as the technical protection devices or any information mechanisms that may be inserted in the contents.
7. Obtain and attempt to obtain the contents using means or procedures other than those which, as the case may be, have been made available for this purpose or which have been expressly indicated on the web pages where the contents are found or, in general, those which are normally used on the Internet because they do not entail a risk of damage or disablement of the Website and/or its contents.

6. RESPONSIBILITIES

The User who visits the Website is fully responsible for accessing it and for the use he/she may make of the information contained in it in accordance with these Terms of Access and Use. RPET FLAKE reserves the right to interrupt the service, or deny the service to the Users, if a use of its Website contrary to these Terms and Conditions is detected. 

RPET FLAKE does not guarantee continuous access, nor the correct visualisation, downloading or use of the elements and information contained in the Website, which may be impeded, hindered or interrupted by factors or circumstances beyond its control, and especially by: 

1. Interferences, interruptions, faults, omissions, telephone breakdowns, delays, blockages or disconnections in the operation of the electronic system, caused by deficiencies, overloads and errors in the telecommunications lines and networks, or any other cause beyond the control of the company. 
2. Illegitimate intrusions through the use of malicious programmes of any kind and through any means of communication, such as viruses or any other means.
3. Improper or inappropriate use of the Website.
4. Security or browsing errors caused by a malfunction of the browser or by the use of non-updated versions of the same. The Website administrator reserves the right to withdraw, totally or partially, any content or information contained in the Website.

RPET FLAKE excludes any liability for damages of any kind that may be caused by the misuse of the freely available services by the Users of the Website. Likewise, RPET FLAKE shall be exonerated from any liability for the content and information that may be received as a result of the data collection forms, being the same only for the resolution of queries and doubts. 

The User shall indemnify RPET FLAKE against any damages arising from claims, actions or demands from third parties as a consequence of his/her access or use of the Website. Likewise, the User undertakes to indemnify RPET FLAKE against any damages arising from the use by the User of “robots”, “spiders”, “crawlers” or similar tools used for the purpose of collecting or extracting data or any other action by the User which imposes an unreasonable burden on the operation of the Website.

RPET FLAKE’s Website may include links (such as links, banners, etc.) to other websites, managed by third parties, in order to facilitate the User’s access to the information of collaborating and/or sponsoring companies. 

RPET FLAKE is not responsible for the content of such websites, nor is it a guarantor and/or provider of the services and/or information that may be offered to third parties through third party links.

The User is granted a limited, revocable and non-exclusive right to create links to the homepage of the Website exclusively for private, non-commercial use. Websites that include a link to our Website (i) may not misrepresent their relationship or state that such a link has been authorised, or include trademarks, names, trade names, logos or other distinctive signs of our company; (ii) may not include content that may be considered in bad taste, obscene, offensive, controversial, inciting violence or discrimination based on sex, race or religion, contrary to public order or unlawful; (iii) may not link to any page of the Website other than the homepage; (iv) must link to the Website’s own address, without allowing the linking website to reproduce the Website as part of its website or within one of its frames or to create a browser over any of the Website’s pages. RPET FLAKE may request, at any time, that you remove any link to the Website, after which you shall immediately proceed to remove such link.

RPET FLAKE cannot control the information, contents, products or services provided by other websites with links to the Website. The establishment of a link to other websites does not imply in any case the existence of a relationship between RPET FLAKE and the owner of such other website, nor the acceptance by RPET FLAKE of its contents or services, unless otherwise stated. 

8. DATA PROTECTION

It is possible that, in order to use some of the Services, the User may have to provide certain personal data beforehand. In this case, RPET FLAKE will automatically process this data and will apply the corresponding security measures, all in compliance with the RGPD, LOPDGDD and LSSI. RPET FLAKE reserves the right to use “cookie” technology on the Website, in order to recognise you as a frequent User and to personalise your use of the Website.

10. REPRESENTATIONS AND WARRANTIES

In general, the content and services offered on the Website are for information purposes only. Therefore, by offering them, no warranty or representation is given in relation to the content and services offered on the Website, including, but not limited to, warranties of legality, reliability, usefulness, truthfulness, accuracy, or merchantability, except to the extent that such representations and warranties cannot be excluded by law.

11. FORCE MAJEURE

RPET FLAKE shall not be liable for the impossibility to provide service if this is due to prolonged interruptions of the electricity supply, telecommunication lines, social conflicts, strikes, rebellion, explosions, floods, acts and omissions of the Government, and in general all cases of force majeure or fortuitous events.

12. INDEPENDENCE AND INTEGRATION OF CLAUSES

In the event that any clause of the present Conditions of Access and Use should be unenforceable or null and void by virtue of the applicable legislation or as a consequence of a judicial or administrative decision, such unenforceability or nullity shall not render the present Conditions of Access and Use unenforceable or null and void as a whole. In such cases, RPET FLAKE will proceed to modify or replace such stipulation with another one which is valid and enforceable and which, as far as possible, achieves the objective and pretension reflected in the original stipulation.

13. MODIFICATIONS TO THE CONDITIONS OF ACCESS AND USE

RPET FLAKE reserves the right to modify the contents of the Website, at any time and without prior notice, and the User shall consult these Terms of Access and Use regularly. In case of modification of the present Terms of Access and Use, the date of update will be indicated at the top of the page, and the User will be deemed to have accepted them if he/she continues using the Website.

14. RESOLUTION OF DISPUTES. APPLICABLE LAW AND JURISDICTION

These Conditions of access and use, as well as the use of the Website, shall be governed by Spanish law. 

For the resolution of any dispute, the parties shall submit to the Courts and Tribunals of the registered office of RPET FLAKE.
